Tend Terms of Service

Welcome to Tend. These Terms of Service ("Terms") are a legal agreement between you and Hearth LLC, a Minnesota limited liability company ("Hearth," "we," "us," or "our"), the company that makes the Tend mobile application ("Tend" or the "App"). Questions any time at [email protected].

By creating a Tend account, downloading the App, or otherwise using Tend, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use Tend.

1. Who can use Tend

You must be at least 13 years old to use Tend. If you are between 13 and the age of majority in your jurisdiction, you may only use Tend with the consent of a parent or legal guardian who agrees to these Terms on your behalf. You also agree that you can form a binding contract with us under the laws that apply to you.

2. Your account

You are responsible for the activity on your Tend account, for keeping your login credentials secure, and for the accuracy of the information you give us (home address, year built, square footage, and so on). If you believe someone else has accessed your account, email us at [email protected] so we can help.

3. Your content

You keep ownership of everything you put into Tend — your home profile, projects, appliances, vendors, reminders, photos, documents, and chat messages ("Your Content").

To run Tend for you, you grant us a worldwide, non-exclusive, royalty-free license to host, store, copy, process, transmit, and display Your Content solely for the purpose of operating, maintaining, securing, and improving Tend for you. This license ends when you delete the content or close your account, except where we are required to keep a copy for legal, backup, or security reasons.

We do not sell Your Content. We do not use Your Content to train third-party AI models. We do not show your data to advertisers.

4. AI features — important disclaimer

Tend uses artificial intelligence to surface insights, answer questions in chat, estimate project costs, suggest vendors, and help organize your home. AI features are provided on an "AS-IS" and "AS-AVAILABLE" basis, without any warranty of any kind. Specifically:

• AI responses are not professional advice. They are not a substitute for a licensed contractor, electrician, plumber, structural engineer, HVAC technician, inspector, attorney, financial advisor, or any other qualified professional.
• Cost estimates, vendor recommendations, project guidance, safety information, and similar outputs are best-effort suggestions. They can be incomplete, out of date, or wrong. Verify anything important — especially anything involving safety, code compliance, electrical, gas, structural, or significant spending — with a qualified professional before acting on it.
• You are solely responsible for decisions you make and actions you take based on AI output. Tend is a planning and organizing companion, not a decision-maker.
• AI features can change, be limited, or be removed at any time without notice.

If something Tend's AI tells you doesn't seem right, please do not act on it. Reply to our team at [email protected] or use the in-app feedback option so we can investigate.
